How much notice does a landlord have to give for unpaid rent in Florida?
Short answer
Before evicting: 3-day notice to pay rent (weekends and holidays excluded) or 7-day notice for other lease violations
Notice: 3 days (excluding Saturdays, Sundays and legal holidays) to pay rent; 7 days to cure other violations
For unpaid rent, deliver a written 3-day demand for rent or possession (excluding Saturday, Sunday and court-observed holidays) before terminating. For other curable violations, give a 7-day notice to cure; for serious or repeat violations, a 7-day notice to vacate. The statute sets the wording, and the notice requirements cannot be waived in the lease.
"If the tenant fails to pay rent when due and the default continues for 3 days, excluding Saturday, Sunday, and legal holidays, after delivery of written demand by the landlord for payment of the rent or possession of the premises, the landlord may terminate the rental agreement." flsenate.gov
"if the noncompliance is not corrected within 7 days from the date that the written notice is delivered, the landlord shall terminate the rental agreement by reason thereof." flsenate.gov
"The notice requirements of subsections (1)-(3) may not be waived in the rental agreement." flsenate.gov
