Do landlords have to file Form 1099-NEC or 1099-MISC, and when are they due?
These federal information-return rules apply in every state when you pay others in the course of a trade or business. Everything below is quoted from IRS instructions on irs.gov; dates moved for weekends are labeled as computed.
Short answer
File and furnish Form 1099-NEC for 2026 contractor payments of $2,000+
When: Due January 31, 2027 (for 2026 payments); if that falls on a weekend or legal holiday, the next business day
If you paid a non-employee (e.g., a contractor or handyman) at least $2,000 for services in 2026 in the course of your trade or business, file Form 1099-NEC with the IRS and furnish a copy to the payee by January 31, 2027. Because January 31, 2027 is a Sunday, the due date moves to the next business day (Monday, February 1, 2027).
"For tax years beginning after 2025, the minimum threshold amount for reporting certain payments required to be reported on certain information returns and/or perform backup withholding on those payments increased to $2,000" irs.gov
"You are required to furnish the payee statements and file with the IRS by January 31." irs.gov
"If any date shown falls on a Saturday, Sunday, or legal holiday in the District of Columbia or where the return is to be filed, the due date is the next business day." irs.gov
For payments made in 2026, the usual reporting threshold for these forms is $2,000. The 2025 instructions, used for forms filed in early 2026, still said $600.
"For tax years beginning after 2025, the minimum threshold amount for reporting certain payments required to be reported on certain information returns and/or perform backup withholding on those payments increased to $2,000" irs.gov
"If you made any payments in 2025 that would require you to file any Forms 1099, check the “Yes” box. ... In general, if you paid at least $600 for services performed by someone who is not your employee (nonemployee compensation), you must file Form 1099-NEC." irs.gov (2025 Schedule E instructions)

E-file your 1099s if you file 10 or more information returns in a year (the IRS IRIS portal is free) Verified
Deadline: Ongoing requirement with no fixed date
If you must file 10 or more information returns in a year, counting all types together, you have to file them electronically. The IRS IRIS Taxpayer Portal is a free way to e-file Forms 1099 without special software (it needs a Transmitter Control Code, which can take up to 45 days). If you file on paper, send Copy A of the forms to the IRS with Form 1096.
Who it covers: Counts all information returns together (for example 1099-NEC and 1099-MISC), not each form type separately. Paper filers send Copy A with Form 1096.
"If you are required to file 10 or more information returns during the year, you must e-file. The 10-or-more requirement does not apply separately to each type of form." irs.gov
"The IRS has developed a free online portal that allows taxpayers to e-file Forms 1099 after December 31, 2022, for 2022 and later returns." irs.gov
"As the TCC application process may take up to 45 days to process, you should apply before the filing season." irs.gov
"You must send Copies A of all paper Forms 1097, 1098, 1099, 3921, 3922, 5498, and W-2G to the IRS with Form 1096, Annual Summary and Transmittal of U.S. Information Returns." irs.gov

File and furnish Form 1099-NEC for 2026 contractor payments of $2,000+ VerifiedComputed date
Deadline: Due January 31, 2027 (for 2026 payments); if that falls on a weekend or legal holiday, the next business day
Computed due date: Monday, February 1, 2027. January 31, 2027 is a Sunday, so the due date moves to the next business day: Monday, February 1, 2027. This date is calculated by us from the quoted base rule, not quoted from the source. Base rule: If any date shown falls on a Saturday, Sunday, or legal holiday in the District of Columbia or where the return is to be filed, the due date is the next business day.
Who it covers: Only payments made in the course of a trade or business; personal payments are not reportable. Whether a small landlord's rental activity is a trade or business depends on facts; see IRS guidance. Threshold rose from $600 to $2,000 for tax years beginning after 2025 (payments made in 2026). Attorney gross proceeds remain $600.

Notes: Source is the IRS Instructions for Forms 1099-MISC and 1099-NEC (Rev. 12/2026). The Feb 1, 2027 date is computed by applying the stated weekend rule; it is not quoted. Topic 'tax-information-returns' is outside the requested topic list (federal tax item requested explicitly). The 2025 Schedule E instructions (for payments made in 2025, reported in early 2026) still give the old $600 threshold; that quote is included to show the change, not as the current rule.
